This has been the law since voters approved a constitutional amendment in November 2020. Retail sales for adult-use began in April 2022. The market has been operating and expanding since then, with dozens of licensed dispensaries now serving communities across the state.

What Adults 21+ Can Legally Do

  • Buy cannabis from any licensed dispensary in New Jersey. Up to one ounce (28 grams) of flower per transaction, or equivalent amounts of concentrates, edibles, tinctures, and other products.
  • Possess cannabis at home. Up to six ounces for personal use.
  • Consume cannabis on private property where the property owner allows it. Your home, your yard, a friend's house with permission.
  • Transport cannabis within New Jersey in a sealed container, stored out of driver reach.
  • Gift cannabis to another adult 21 or older. No payment or exchange of value.

What Remains Illegal

Legalization is not a free-for-all. These activities remain illegal in New Jersey:

  • Public consumption. No smoking, vaping, or consuming cannabis in any public place: parks, sidewalks, restaurants, bars, beaches, or any other public venue.
  • Home growing. You cannot grow cannabis plants at home under any circumstances. Not one plant. Full details here.
  • Underage use. Possession, purchase, and consumption by anyone under 21 is illegal. Providing cannabis to minors carries additional penalties.
  • Driving while impaired. Cannabis DUI carries the same penalties as alcohol DUI. Never drive after consuming.
  • Unlicensed sales. Selling cannabis without a CRC license is a criminal offense.
  • Crossing state lines. Transporting cannabis across state borders is a federal offense, even between two legal states.
  • Consuming at work. Employers can prohibit cannabis use during working hours and on company premises.

Where to Buy Legal Cannabis

The only legal way to purchase cannabis in New Jersey is from a dispensary licensed by the Cannabis Regulatory Commission. Licensed dispensaries are regulated facilities where every product has been tested for potency, pesticides, heavy metals, and microbial contaminants. Buying from unlicensed sources is illegal and unsafe.

Not every town in New Jersey allows dispensaries. Cannabis retail is only permitted in municipalities that have opted in through local ordinances. Two Programs

Medical vs. Adult-Use: Key Differences

New Jersey runs two parallel cannabis programs. You do not need a medical card to buy cannabis, but having one offers some advantages:

  • Tax savings. Medical patients pay reduced or no sales tax on cannabis purchases. Adult-use customers pay full state sales tax plus a social equity excise fee.
  • Higher limits. Medical patients may be authorized for higher purchase quantities based on their physician's recommendation.
  • Product access. Some higher-potency products may be available only through the medical program.
  • Age. Medical patients can be under 21 with proper certification. Adult-use is strictly 21+.
  • Qualifying conditions. To enroll in the medical program, a physician must certify a qualifying condition such as chronic pain, anxiety, PTSD, cancer, or epilepsy.
